These Terms govern your access to and use of the websites and services operated by Trinity Healthcare Supply, LLC d/b/a Next Meds ("Next Meds", "we", "us", or "our"), connecting users to the telehealth platform operated by OpenLoop Health, Inc. ("OpenLoop"). Next Meds and OpenLoop are separate legal entities that perform distinct roles. Next Meds provides non-clinical, administrative, and technology services; OpenLoop operates the telehealth platform and coordinates the independent professional entities ("Professional Entities", i.e. OpenLoop Affiliated P.C.s) and their licensed healthcare professionals, and the independent pharmacies (the "Pharmacies") that dispense any prescribed medication.

THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. ALL DISPUTES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION.

Acceptance of Terms

By accessing or using the Website or Services, you agree to be bound by these Terms as a legally binding agreement. If you do not agree, you may not use the Website or Services.

Amendment of Terms

We may amend these Terms from time to time. Your continued use after the amended Terms are posted constitutes acceptance.

Eligibility

You must be at least 18 years of age, reside in the United States in a state where the Services are available, and agree to be legally bound by these Terms to access or use the Services.

Your Relationship with Us

Next Meds does not provide medical advice, diagnosis, or treatment and is not a licensed medical or pharmacy provider. All healthcare services are provided exclusively by the Professional Entities and their licensed healthcare professionals, each of whom is solely responsible for the care they provide. Your use of the platform does not create a provider-patient relationship with Next Meds.

Financial Responsibility

Neither Next Meds nor OpenLoop participate in Medicare, Medicaid, or any private payor program. By using the Services, you elect cash-pay care and are solely financially responsible for all fees. Payment information is processed securely by Stripe (see stripe.com/privacy).

Telehealth Consent

To use the Services you must consent to treatment via telehealth. Please review the Telehealth Informed Consent for the methods, benefits, risks, and limitations of telehealth.

Prescriptions & Subscriptions

Prescription products require a valid prescription issued by a Professional Entity clinician. Subscriptions auto-renew and can be cancelled up to 48 hours before the monthly processing date by emailing care@nextmeds.com.

Content License & Intellectual Property

All content is protected by intellectual property laws. Next Meds grants a limited, non-exclusive, non-transferable license for your personal, non-commercial use only. All trademarks and materials remain the property of Next Meds or its affiliates.

Accuracy, Security & Prohibited Conduct

You are responsible for your use of the Services, and all information you provide must be current, accurate, complete, and truthful. Prohibited conduct includes harassment, fraud, reverse engineering, scraping, uploading malicious content, spam, and any unlawful use of the Website.

Refunds

All sales are final except as stated in the Refund & Cancellation Policy or as required by law. Medical consultation fees are not refundable, and prescription products cannot be returned.

Termination

We reserve the right to terminate or suspend your access at any time, with or without notice, for any reason including violations of these Terms.

Data Retention

Next Meds retains personal information only as long as reasonably necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements.

Indemnification

You agree to defend and hold harmless Next Meds, OpenLoop, the Professional Entities, the Pharmacies, and their affiliates, officers, directors, and employees from any claims arising from your use of the Services.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. Next Meds disclaims all warranties, express or implied, to the maximum extent permitted by law.

Limitation of Liability

Next Meds's aggregate liability shall not exceed the greater of the total amounts you paid in the prior 12 months, or USD $100.

Arbitration; Opt-Out

All disputes between you and Next Meds, OpenLoop, the Professional Entities, and the Pharmacies will be resolved by binding, individual arbitration, and you waive the right to participate in a class action or class arbitration. You may opt out of this Arbitration Agreement within 30 days of your first purchase by sending written notice to Trinity Healthcare Supply, LLC, 3206 NE 2nd Ave, Suite 3013, Miami, FL 33137.

Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute permitted to be brought in court shall be brought in Miami-Dade County, Florida.

Next Meds

*The assessment made available on the Next Meds website does not create a doctor-patient relationship between the individual completing the assessment and Next Meds. OpenLoop Health, a network of US-licensed doctors that adhere to rigorous medical protocols designed for patient safety, has established exclusionary criteria to determine if an individual does not qualify for GLP-1s. The answers an individual provides to the Next Meds assessment consequently determine if the individual is screened out of eligibility for GLP-1 medication, and a OpenLoop Health clinician will meet with an individual after checkout to determine if they qualify for a prescription. OpenLoop Health clinicians retain the decision to prescribe compounded GLP-1s to patients.

All claims and benefits on this website refer to self-reported data from GLP-1 customers on a treatment plan that includes compounded GLP-1 medications and consultations with medical professionals. Customers reported their weight on their initial medical intake questionnaire every 3-4 weeks thereafter. Results from compounded medications found on the Next Meds platform may vary and be affected by an individual's adherence to the program and their clinician's recommendations. Compounded GLP-1s are produced in FDA-regulated facilities. Although these facilities are highly regulated, the medications are not FDA-approved or evaluated for safety, efficacy, or quality. The decision to use compounded drugs is guided by the licensed provider's medical judgment, which is informed by a telehealth consultation and medical history. We encourage all prospective users of compounded medications to speak with their provider about the specific risks and benefits that may come with the use of compounded medication. Next Meds does not produce compounded medications, and individuals may receive medication that looks different than what is portrayed on the website.

Pharmacy Providers: We are partnered with multiple USA certified pharmacies to bring the best product and overall experience to our membership. Our team meets regularly with pharmacies to discuss any product shortages, shipping delays, and get updated reports on their medication testing.

*Results vary based on starting weight and program adherence. Inches lost from hips, waist, chest, thighs and arms in the first month. Patients exercised daily and ate a reduced-calorie diet. Their fat loss is not typical. Results may vary. Medication prescriptions are at the discretion of medical providers and may not be suitable for everyone. Next Meds patients typically result in 1-2 lbs per week weight loss after 4 weeks, involving a healthy diet and exercise changes. Consult a healthcare professional before using medication or starting any weight loss program. *Based on the average weight loss as reported by patients without diabetes who reached and maintained a dose of 2.4 mg/week of GLP-1 treatment, along with a reduced-calorie diet and increased physical activity.

Medication is included in the cost of the Next Meds Program. Wegovy® is FDA-approved for weight loss. Ozempic® is FDA-approved for type 2 diabetes treatment but may be prescribed for weight loss. The trademarks, service marks, trade names (Wegovy®, Ozempic®), and products displayed on this Internet site are protected and belong to their respective owners. Medical treatment is provided by “OpenLoop Affiliated P.C.s,” and OpenLoop Health, affiliated networks for medical professional corporations and associations. No data, photos, claims or any other information is associated with results derived from clinical trials, studies or public information and is always representative of Next Meds patient experience.
